"MedicalMine Inc" is the owner of the CharmEHR, CharmPHR and the related CharmTelehealth solution. Your access to the CharmTelehealth Solution (referred as "Service" hence forth) is an add-on feature to your use of the CharmEHR Product (if you are a healthcare provider). A companion product is available for your patients through their patient portal, CharmPHR. This product for healthcare providers is accessed from within the Patient Electronic Chart area in http://www.charmehr.com.
This document contains Additional Terms of Service for using the CharmTelehealth Service provided by MedicalMine Inc., to its CharmEHR and CharmPHR application users. PLEASE NOTE: The Service hereunder is subject to, and these Telehealth Terms of Service incorporate, all of the Terms of Service (including, without limitation, all disclaimers of warranties, limitations of liability and indemnification obligations set forth therein) applicable to the CharmEHR for users of that service and the Terms of Service applicable to the CharmPHR for users of that service.
CharmTelehealth is a solution for healthcare providers who wish to access their patients remotely using video/media capabilities available using the internet and their desktop or mobile devices. CharmTelehealth is embedded in the CharmEHR product. The provider may schedule appointments for telemedicine consults using any payment model, and connect with patients at the time of consult. The patient logs in through CharmPHR (desktop or mobile) and completes the telemedicine consult online.
Your use of the Service is subject to the fees specified.
Patients should be aware that even though they may be in direct, virtual contact with a healthcare provider through the Service, neither MedicalMine nor the Service provides any medical services including, but not limited to, emergency or urgent medical services.
Patients are advised:
PLEASE USE A PHONE TO CALL 911 OR YOUR HEALTHCARE PROVIDER IF YOU BELIEVE THAT YOU ARE EXPERIENCING A MEDICAL EMERGENCY OR IF YOU ARE EXPERIENCING HEALTH CHANGES THAT ARE WORRISOME TO YOU.
Patients, each time that they use the Service, they will be asked to validate their physical location. Patient must confirm actual location at which patient will be connecting to the Service and communicating with the healthcare provider during the applicable session. Patient warrants that the information provided in that regard is current and accurate.
Each healthcare provider is solely responsible for the delivery of medical care and determining whether such provider is able permitted to do so based on the patient’s location when using the Service for the Telehealth session. For each Telehealth session, the healthcare provider is solely responsible for: (a) confirming that the provider has the necessary licenses, patient connections and qualifications to use the Service to deliver the Telehealth session; and (b) providing Telehealth healthcare and advice using the Service solely within the scope of the providers licenses, qualifications and applicable regulatory requirements.
Both the patients and the healthcare providers acknowledge and agree that neither MedicalMine nor the Telehealth Service provided by MedicalMine offers medical advice or health care. The healthcare provider participating in each Telehealth session through the Service is solely responsible for the delivery of any medical advice or care.
Patients should not assume that the healthcare provider participating in a Telehealth session has access to any or all of the information in the CharmPHR -- or that such information is current, accurate or up-to-date. MedicalMine is not responsible for any healthcare provider’s reliance or non-reliance on any information in CharmPHR or CharmEHR.
ALL USERS OF THE SERVICE ACKNOWLEDGE AND AGREE THAT MEDICALMINE IS SOLELY PROVIDING A TECHNOLOGY PLATFORM AND IS NOT PROVIDING MEDICAL ADVICE OR HEALTHCARE SERVICES. MEDICALMINE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED – AND SHALL HAVE NO LIABILITY OR RESPONSIBILITY – IN CONNECTION WITH ANY HEALTHCARE SERVICES, MEDICAL ADVICE, PRESCRIPTIONS OR MEDICATION RECOMMENDATIONS DELIVERED THROUGH THE MEDICALMINE SERVICE.
MedicalMine, Inc. may amend these Telehealth Terms of Service at any time by (a) posting a revised Telehealth Terms of Service on the CharmEHR and CharmPHR Website, and/or (b) sending information regarding the amendment to the email address you provide to CharmEHR or CharmPHR, as applicable. You are responsible for regularly reviewing the CharmEHR or CharmPHR websites (as applicable) to obtain timely notice of such amendments. You shall be deemed to have accepted such amendments by continuing to use Service after such amendments have been posted or information regarding such amendments has been sent to you.
